Terms of Service — NightChapter

1. Overview

These Terms of Service govern your use of the NightChapter website and purchases made through our store. Throughout these terms, “NightChapter,” “we,” “us,” and “our” refer to the seller operating under the NightChapter brand.

Please review these terms before placing an order. Our Refund & Returns Policy and any shipping terms presented before purchase also apply to your order.

Nothing in these terms limits rights that cannot legally be excluded under applicable consumer protection law.

2. Eligibility & Website Use

To place an order, you must be legally capable of entering into a binding contract or have the authorization of a parent or legal guardian.

You agree to use our website lawfully and provide accurate information when ordering or contacting us.

You must not:

• Use fraudulent payment details or impersonate another person;
• Attempt to gain unauthorized access to the website or its systems;
• Introduce malicious software or interfere with website security;
• Use the website for unlawful activities; or
• Submit fraudulent orders, claims, or reviews.

We may restrict access where reasonably necessary to address fraud, security threats, or unlawful use. Such restrictions do not remove rights relating to existing purchases.

3. Product Information

NightChapter sells reading accessories, including the Book Reading Light.

Please review the product description, dimensions, photographs, included components, and operating instructions before purchasing.

Screen settings and photography may affect the appearance of colors and lighting. These variations do not excuse supplying a product that is materially different from its description.

Reading comfort and perceived brightness depend on factors such as ambient lighting, book size, paper finish, selected settings, and personal preferences.

Battery runtime varies with brightness, settings, and use. Advertised maximum runtime is not a guarantee of identical performance under every condition.

The Book Reading Light is not a medical device and is not intended to diagnose, treat, cure, or prevent medical conditions.

4. Prices & Payment

The currency and price applicable to your purchase are displayed on the website and at checkout. Applicable shipping charges and taxes collected by us will be shown before you complete your order.

You authorize the payment method you provide to be charged for the total amount you approve at checkout.

Prices and promotions may change for future purchases. Changes will not increase the price of an order already accepted without your agreement.

Promotional offers are subject to the conditions disclosed with each offer.

5. Orders & Availability

After placing an order, you will receive an acknowledgment confirming that we have received it. We may need to verify payment, stock availability, or order details before fulfillment.

We may decline or cancel an order for a legitimate reason, including unavailable stock, failed payment, suspected fraud, or a material pricing error.

If an issue affects your order, we will notify you. We will not substitute a materially different product or charge a higher price without your agreement.

If we cancel an order after collecting payment, we will refund the amount paid for the canceled items and any associated charges that are no longer applicable.

6. Accurate Customer Information

You are responsible for providing accurate contact, billing, and shipping details.

If you discover an error, contact supportnightchapter@gmail.com promptly. We will attempt to help, but changes may not be possible once fulfillment or shipment has begun.

Any additional costs arising from customer-provided address errors will be explained before reshipment and charged only where permitted by law. You will not be charged costs caused by our error.

7. Shipping & Delivery

Shipping options, charges, and estimated timeframes are provided at checkout or in our Shipping Policy.

Delivery estimates may be affected by carrier operations, holidays, weather, and other disruptions. These circumstances do not remove our obligations concerning shipment, delay notices, cancellations, or refunds.

If we cannot ship within the promised timeframe, we will notify you and provide the applicable options to accept the delay or cancel for a refund.

If your parcel is missing, delayed, or marked delivered but cannot be located, contact supportnightchapter@gmail.com. We will review the circumstances and assist with an appropriate investigation.

A carrier delivery scan does not automatically remove your right to have a missing-package claim assessed.

8. Changes & Cancellations

Contact us as soon as possible if you wish to change or cancel an order.

We cannot guarantee changes or cancellations once fulfillment has begun. After dispatch, requests will be handled under our Refund & Returns Policy and applicable law.

This does not restrict any mandatory cancellation rights, including those arising from shipping delays.

9. Returns & 30-Day Limited Warranty

Our Refund & Returns Policy explains the conditions and procedures for returns, replacements, and refunds.

NightChapter provides a 30-day limited warranty from delivery for covered problems attributable to us, including manufacturing defects, damage on arrival, incorrect items, missing supplied components, and products materially different from their description.

For eligible claims, we provide an appropriate replacement, replacement component, or refund at no cost to you, as described in that policy.

This is not a satisfaction guarantee. We do not accept returns solely for a change of mind, ordering mistakes, or personal preferences where the product functions as described, except where required by law.

The 30-day warranty does not shorten any rights or remedies available for a longer period under applicable law.

10. Product Use & Care

Use, store, and charge the product according to the instructions supplied with it.

Do not continue using or charging a product that appears damaged, overheats unusually, or shows signs of battery swelling or leakage. Contact us for assistance and appropriate handling instructions.

Damage caused by misuse, accidental breakage, or use contrary to the supplied instructions is distinct from a manufacturing defect. Any exclusion applies only where that conduct caused the damage and where permitted by law.

11. Reviews & Feedback

If you submit a review or feedback, it must reflect your genuine experience and must not contain unlawful content, personal information belonging to others, or material you do not have permission to share.

When you submit a review for publication, you allow NightChapter to display it with the display name you provide and make minor formatting changes without altering its meaning.

We may remove spam, fraudulent content, unlawful material, or content that violates another person’s rights. We will not remove a review solely because it expresses a negative opinion.

12. Intellectual Property

Website content owned by or licensed to NightChapter—including branding, original text, graphics, and designs—is protected by applicable intellectual property laws.

You may browse and use the website for personal shopping purposes. You may not reproduce or commercially exploit protected content without permission, except where permitted by law.

Third-party names and materials remain the property of their respective owners.

Separate terms may apply to those services. We do not control unrelated third-party websites.

Using third-party providers does not remove our responsibilities to you as the seller.

Please do not send passwords, full payment-card details, or other unnecessary sensitive information to our support email.

15. Website Availability & Errors

We aim to keep the website accurate and available, but temporary interruptions and errors may occur.

We may correct website errors and update information. Corrections will not be used to remove rights arising from an existing purchase or materially change an accepted order without your agreement.

Statements about website availability do not disclaim product warranties or mandatory consumer rights.

16. Responsibility & Consumer Rights

Nothing in these terms excludes or limits liability for fraud, willful misconduct, or any other liability that cannot legally be excluded or limited.

Nothing disclaims implied warranties or statutory remedies where such a disclaimer is prohibited. Your rights may vary depending on where you live.

Contacting us does not waive your rights to seek assistance from your payment provider, a consumer protection authority, or a court with jurisdiction.

These terms do not require mandatory arbitration or waive participation in a class action.

The terms presented when you place your order will govern that purchase unless a change is required by law or you expressly agree otherwise.

Updates will not retroactively reduce your rights under an existing order.

19. Severability
